In 1920 Congress created this act to ensure that seamen, sailors and ship’s crew members, are treated fairly by their employers while maintaining a safe environment. The Jones Act offers injured seamen and certain offshore workers to compensation outside of workers’ compensation by filing a lawsuit against his or her employer.

If a seaman is injured or died on the job due to negligence of his or her employer or employees, the seaman or his family can file a lawsuit against the employer.

Who Is Considered a Seaman?

A seaman is any individual that contributed to the work of the vessel or worked on the vessel while in motion. Vessels consist of ocean freighters and tankers, tugs and barges, offshore crew boats and work boats, and drilling rigs.
